Leandra's Law
Signed into law in 2009, the Child Passenger Protection Act — often referred to as Leandra's Law — makes it an automatic felony on the first offense to drive drunk with a child 15 or younger in the vehicle.
If charged under this law, you could be facing a prison sentence of up to four years, a fine between $1,000 and $5,000, and the installation of an ignition interlock device on your vehicle. You also face the suspension of your driver's license for 12 months and reporting to the Statewide Central Register of Child Abuse and Maltreatment.
How We Can Help You Protect Your Rights
If you are facing the staggering penalties associated with a conviction under Leandra's Law, we will leave no stone unturned in your defense. We will find the answers to important questions such as:
- Why were you pulled over?
- Were proper procedures followed by the police?
- Were field sobriety tests administered?
- Was a breath test given?
We work with outside experienced litigators to examine all aspects of a felony DWI case, including an expert on chemistry who has written on the subject of breath test effectiveness. This gives our clients a scientific edge that can help their case in and out of the courtroom.
