Chapter 7 Bankruptcy
Chapter 7 bankruptcy is a type of liquidation that is preferable for many people. This type of bankruptcy excuses your debts and allows you to keep exempt property like your car, the equity you have in your home, your pension and much of your income.
However, not everyone can qualify for Chapter 7 bankruptcy. In order to qualify, you must pass the bankruptcy means test which was introduced as part of the 2005 changes to the nation's bankruptcy laws. If your income is too high to qualify for Chapter 7, you may qualify for a Chapter 13 debt payment plan that will require you to pay creditors some of what you owe them.
Once you file for Chapter 7, an automatic stay will go into effect which will prevent harassment from creditors, threats of repossession and wage garnishments.
