The Automatic Stay Prohibits Creditor Harassment
Filing for bankruptcy gives you the protection of the automatic stay. This halts all collection activities while the bankruptcy is in progress. Creditors will not be allowed to harass you or attempt to collect on debts through any means, including:
- Phone calls
- Letters
- Bank seizures
- Income garnishments
- Foreclosure
- Vehicle repossession
Creditors are prohibited from contacting you directly when you file bankruptcy. They must contact your attorney instead. If a creditor tries to contact you or collect on a debt after the bankruptcy has been filed, you may be able to take action against it.
