Debt Relief in New York State
Being in debt is one of the most stressful situations a person can experience. Once creditors begin harassing you and your family, the pressure increases. You may feel as if there is no solution to the problem, but an experienced lawyer can review your finances and help you find a way out of debt.
Bankruptcy puts an immediate end to creditor harassment. The minute your bankruptcy petition is filed, you are protected by federal law from all collection efforts, including creditor harassment. At Silver, Forrester & Lesser, P.C., we help people file bankruptcy and take their lives back. To schedule a consultation with our Orange County creditor harassment and bankruptcy attorneys, please call 845.764.4757 or toll free at 866.687.1338, or contact us online.
The Automatic Stay Prohibits Creditor Harassment
Filing for bankruptcy gives you the protection of the automatic stay. This halts all collection activities while the bankruptcy is in progress. Creditors will not be allowed to harass you or attempt to collect on debts through any means, including:
- Phone calls
- Bank seizures
- Income garnishments
- Vehicle repossession
Creditors are prohibited from contacting you directly when you file bankruptcy. They must contact your attorney instead. If a creditor tries to contact you or collect on a debt after the bankruptcy has been filed, you may be able to take action against it.
All chapters of bankruptcy provide the protection of the automatic stay. After we review your debts, assets and income, we will determine if bankruptcy is right for you and whether Chapter 7 or Chapter 13 is the appropriate option.
