Hardship License ? Conditional License

Has your license been revoked due to a DWI charge? At Silver, Forrester, Schisano & Lesser, P.C., our goal is to get you driving as soon as possible. One way to do this is by seeking a temporary license:

  • Hardship license - This type of license may be granted to an individual who is pending prosecution for DWI. To qualify for this license, it must be proved that the loss of license will cause extreme hardship: inability to go to work or school, or inability to get medical care. Then, the license can be used only for the reasons for which it was originally granted. A hardship license is valid for 30 days.
  • Conditional license - An individual who has had his or her license revoked may be eligible for a conditional license. This is dependent on participation in New York's Drinking Driver Program (DDP.) A conditional license can be used to get to work or classes, to transport children to daycare, to go to medical appointments, and for other restrictive uses.

Breath Test Refusal - Automatic License Suspension

If you refused to take a chemical test at your arrest, your license will be taken by the court and a refusal hearing will be scheduled within 15 days of the arrest.
