Vehicular Assault, Manslaughter and Homicide

  • Vehicular assault in the second degree — Driver causes serious injury to another and is either intoxicated or under the influence of drugs, or operates a vehicle with a gross vehicle weight of more than 18,000 pounds and containing flammable materials while intoxicated or under the influence of drugs. Class E felony punishable by up to four years in prison.
  • Vehicular assault in the first degree — Driver causes serious injury while having a blood alcohol content (BAC) of .18 percent or more, or is under the influence of drugs; or while driving on a revoked license; or has prior convictions for vehicular crimes; or injures more than one person; causes the death of a child 15 years or younger in the vehicle. Class D felony punishable by up to seven years in prison.
  • Vehicular manslaughter in the second degree — Driver causes the death of a person while intoxicated or under the influence of drugs; or operates a vehicle with a gross vehicle weight of more than 18,000 pounds and containing flammable materials. Class D felony punishable by up to seven years in prison.
  • Vehicular manslaughter in the first degree — Driver causes the death of one or more people while having a BAC of .18 percent or more, or under the influence of drugs; and while license is suspended for DWI/DUI conviction or Breathalyzer refusal. Class C felony punishable by up to 15 years in prison.
  • Aggravated vehicular homicide — Driver causes the death of one or more people while having a BAC of .18 percent or more, or under the influence of drugs; and while license is suspended for DWI conviction or Breathalyzer refusal; or has prior DWI or vehicular homicide convictions; or causes the death of one or more people and the serious injury of one or more people; causes the death of a child 15 years or younger in the vehicle. Class B felony punishable by up to 25 years in prison.
