Multiple Offenses

New York Vehicle and Traffic Law imposes mandatory incarceration or the performance of community service for anyone convicted of DWI who also has one or more prior convictions for drinking and driving within the previous five years. The specific penalties depend on the number of prior convictions.

Second Offenses - A second DWI conviction within 10 years of the first is considered a felony. If convicted, an individual faces:

  • Mandatory fines of up to $5,000
  • Up to four years in prison
  • License revocation for up to 18 months

Third Offenses - A third offense within 10 years of the first is a felony and can result in:

  • Fines of up to $10,000
  • Up to seven years in prison
  • License revocation for up to 18 months (and the possibility of permanent license revocation)

Any DWI conviction can yield insurance consequences. Because a second or subsequent DWI is a felony, an individual's right to vote may be affected. Additionally, as a felon he or she may be unable to enter Canada. (This is true even with a conviction for the violation of DWAI)
