Hardship License - Conditional License

Has your license been revoked due to a DWI charge? At Silver, Forrester & Lesser, P.C., our goal is to get you driving as soon as possible. One way to do this is by seeking a temporary license:

  • Hardship license - This type of license may be granted to an individual who is pending prosecution for DWI. To qualify for this license, it must be proved that the loss of license will cause "extreme hardship" as defined by NY VTL §1193[2](e)(7)e: the inability to obtain alternative means of travel to or from the licensee's employment, or to or from necessary medical treatment for the licensee or a member of the licensee's household, or if the licensee is a matriculating student enrolled in an accredited school, college or university travel to or from such licensee's school, college or university if such travel is necessary for the completion of the educational degree or certificate. If you do qualify for a hardship license, it can be used only for the reasons for which it was originally granted. A hardship license is valid for 30 days and can be replaced by a pre-conviction conditional license which has more liberal driving privileges.
  • Conditional license - An individual who has had his or her license revoked may be eligible for a conditional license. This is dependent on participation in New York's Drinking Driver Program (NY VTL§ 1196). A conditional license can be used to get to work or classes, to transport children to daycare, to go to medical appointments, and for other restrictive uses. In many cases, attendees of the DDP are sent for additional assessment and/or treatment. We can help you determine if you are eligible for a conditional license and if the program is right for you.

Breath Test Refusal - Automatic License Suspension

If you refused to take a chemical test at your arrest, your license will be taken by the court and a refusal hearing will be scheduled within 15 days of the arrest. Our firm's attorneys can represent you at the administrative hearing. We will examine your arrest to determine if there was probable cause for the arrest, and to determine if you were properly warned of the subsequent license suspension.
