We Argue for Diversionary Programs and Alternative Sentences

In 2009, the Rockefeller Drug Laws were revised by the New York Legislature. The changes eliminated mandatory minimum sentences for non-violent offenders who are convicted of drug offenses. Many people were critical of the Rockefeller Drug Laws because these harsh mandatory minimum sentences led to a drastic increase in the New York prison population.

Under the revised New York drug sentencing guidelines, judges may decide to order treatment programs, probation, split sentences or shorter prison terms for individuals convicted of drug crimes. Despite these reforms, however, it is still important to have legal representation if you are charged with a drug crime in New York because the consequences of conviction are severe. Stay Out of Jail

The revised Rockefeller Drug Laws are much less restrictive for people charged with drug crimes and nonviolent crimes caused by drug addiction. In these cases, we can request an evaluation before you enter a plea. If the evaluation shows that you may benefit from drug treatment, you may enter a diversionary program instead of going to jail or prison. You must successfully complete the program to avoid a regular trial or sentence. After successful completion, you may vacate the felony plea and have it reduced to a misdemeanor.

There are other diversionary programs/prison alternatives available as well. If you are eligible for one of these, we will fight hard to keep you out of jail. We work diligently to help you get your life back.

Without an attorney to protect your rights, however, you may be overcharged with a more serious offense or subject to violation of your constitutional rights. As former Orange County assistant district attorneys, we know how to review evidence in drug cases. Working with experienced investigators, we determine the facts of the case and ensure that clients are not victims of overzealous prosecution. If you have been charged with a drug crime, even if it is a first offense, contact us today.
